INDEMNIFICATION

Landlords, brokers, tenants and other persons who access the website (collectively “Users” and each individually a “User”) acknowledge and understand that RentalsDB LLC (“RentalsDB”) provides a fee-free website (the “Website”) that serves as a meeting place between Users who desire to enter into a real estate rental agreement or to facilitate such an agreement. User understands that RentalsDB does not (i) screen the Users of the website; (ii) research or verify the truth and accuracy of any and all information provided by the Users, including but not limited to, personal and financial information and representations relating to their knowledge of certain real estate rental properties; (iii) make any representations that a rental contract will arise from User’s use of the Website; (iv) assume responsibility for the accuracy or existence of any communication between Users; or (v) enforce payments of any kind between Users. User further understands that it is his/her sole responsibility to conduct normal and customary due diligence relating to the information featured on the Website and representations made by other Users or by any third party, including but not limited to, property managers and other employees and representatives of other Users with whom the User may come into contact, whether directly or indirectly related to or arising from the use of the Website.

As laws vary by state, RentalsDB strongly encourages Users to review the terms of any real estate rental agreement or any other contract with his/her attorney prior to signing.

WARRANTY DISCLAIMER

USER UNDERSTANDS AND AGREES THAT HIS/HER USE OF THE WEBSITE IS AT USER’S SOLE RISK. THE WEBSITE AND THE CONTENT THEREOF ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. RENTALSDB DOES NOT GUARANTEE THAT (a) THE USE OF THE WEBSITE WILL RESULT IN A RENTAL AGREEMENT; (b) THE QUALITY OF ANY INFORMATION OBTAINED BY USER FROM THE WEBSITE OR AS A RESULT OF USE OF THE WEBSITE WILL MEET USER’S EXPECTATIONS; (c) THE INFORMATION PROVIDED BY THE WEBSITE OR OBTAINED AS A RESULT OF USER’S USE OF THE WEBSITE IS ACCURATE; (d) ANY ERRORS ON THE WEBSITE WILL BE CORRECTED; AND (e) THE OPERATION OF THE WEBSITE WILL BE UNINTERRUPTED AND ERROR-FREE. RENTALSDB IS NOT LIABLE FOR ANY LOSS, DAMAGE, OR DELETION OF ANY PHOTO OR FILES STORED ON OR TRANSMITTED TO OR FROM THE WEBSITE. ANY MATERIAL DOWNLOADED OR OTHERWISE ACCESSED THROUGH THE USE OF THE WEBSITE OR AS A RESULT OF THE USE OF THE WEBSITE IS DONE AT USER’S OWN DISCRETION OR RISK AND USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO USER’S COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF ANY SUCH MATERIAL. RENTALSDB HAS THE RIGHT TO REMOVE ANY WEBSITE CONTENT AT ANY TIME, FOR ANY REASON OR FOR NO REASON, WHETHER POSTED BY A USER OR RENTALSDB ITSELF. RENTALSDB SHALL REPORT ANY UNLAWFUL, PORNOGRAPHIC OR OTHERWISE INAPPROPRIATE MATERIALS POSTED ON THE WEBSITE TO THE APPLICABLE AUTHORITIES. USERS ARE ENCOURAGED TO ALERT RENTALSDB OF THE PRESENCE OF SUCH INAPPROPRIATE MATERIAL.

LIMITATION OF LIABILITY

USER EXPRESSLY AGREESS AND UNDERSTANDS THAT RENTALSDB AND/OR ITS MANAGERS, EMPLOYEES, AGENTS, AFFILIATES, SUCESSORS, HEIRS, AND ASSIGNS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES OR OTHER INJURY ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THIS WEBSITE , WITH THE DELAY OR INABILITY TO USE THE WEBSITE , AND/OR OTHERWISE RISING OUT OF THE USE OF THIS WEBSITE, WHETHER RESULTING IN WHOLE OR IN PART FROM BREACH OF CONTRACT (INCLUDING NON-PAYMENT), TORTIOUS BEHAVIOR, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF USER HAS PREVIOUSLY INFORMED RENTALSDB OF THE POSSIBILITY OF DAMAGES. SOME STATES DO NOT ALLOW THE LIMITATION OF LIABILITY AND DISCLAIMER OF IMPLIED WARRANTIES; IN SUCH STATES, THE LIABALITY OF RENTALSDB AND/OR ITS MANAGERS, EMPLOYESS, AGENTS, AFFILIATES, SUCCESSORS, HEIRS, AND ASSIGNS WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
